1. About these terms
These terms govern your use of Tally Up, an income and expense tracking service for Isle of Man sole traders, operated by Tally Up Limited. Tally Up Limited is registered in the Isle of Man (company number 138973C) with its registered address at 15 Birch Hill Grove, Onchan, Isle of Man, IM3 4EL. References to "we", "us", or "our" in these terms refer to Tally Up Limited. By creating an account or using the service, you agree to these terms. If you do not agree, please do not use the service. These terms are governed by the laws of the Isle of Man.
2. The service
Tally Up is an income and expense tracker that helps you organise your income, expenses, invoices, and tax records.
3. Your account
To use Tally Up, you must create an account with a valid email address. You are responsible for: • Keeping your login details secure • Keeping your account information accurate and up to date • All activity that occurs under your account Each person may only hold one account.
4. Acceptable use
You agree not to: • Use the service for any unlawful purpose • Upload any content that is illegal, harmful, or infringes on others' rights • Attempt to access other users' accounts or data • Interfere with or disrupt the service • Use automated tools to access the service without our permission
5. Subscriptions and payments
Tally Up offers free and paid subscription tiers. Paid subscriptions are billed through PayPal. If payment fails, we may restrict access to paid features until the payment issue is resolved. We will notify you before taking any action. You can cancel your subscription at any time. Cancellation takes effect at the end of your current billing period.
6. Your data
You own the data you enter into Tally Up. We process your data in accordance with our Privacy Notice. You can export or delete your data at any time through the application. For full details on how we handle your data, please see our Privacy Notice.
7. Intellectual property
Tally Up, including its design, code, and branding, is owned by Tally Up Limited and protected by intellectual property laws. You retain ownership of all content you create or upload to the service. By using the service, you grant us a limited licence to store and process your content solely for the purpose of providing the service to you.
8. Service availability
We aim to keep Tally Up available at all times, but we cannot guarantee uninterrupted access. The service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We do not offer a formal service level agreement (SLA). We will make reasonable efforts to notify you in advance of planned maintenance.
9. Limitation of liability
To the maximum extent permitted by Isle of Man law: • Tally Up is provided "as is" without warranties of any kind • We are not liable for any indirect, incidental, or consequential damages arising from your use of the service • We are not liable for any tax penalties, missed deadlines, incorrect filings, or financial losses arising from your use of or reliance on the service • Our total liability to you for any claim arising from these terms shall not exceed the amount you have paid us in the 12 months preceding the claim Nothing in these terms limits our liability for fraud, death, or personal injury caused by our negligence, or any other liability that cannot be excluded by law.
10. Termination
You can close your account at any time through the application or by contacting us. We may suspend or terminate your account if you breach these terms, with reasonable notice where possible. On termination, you will have 30 days to export your data before it is deleted. Some data may be retained where required by law.
11. Changes to these terms
We may update these terms from time to time. If we make material changes, we will notify you by email at least 30 days before the changes take effect. Continued use of the service after changes take effect constitutes acceptance of the updated terms.
12. Governing law
These terms are governed by the laws of the Isle of Man. Any disputes arising from these terms or your use of the service shall be subject to the exclusive jurisdiction of the courts of the Isle of Man.
